Zuck Found Guilty

This reflection was published on March 26 of 2026, the day after the verdict. I am currently exploring formal participation in the case as a plaintiff.

For years, anyone who flagged Instagram’s underlying user experience design (the aquarium) as harmful to both children and adults (the fish, which also applies to the content itself) was treated like a melodramatic aunt who fails to appreciate a good time. We were told the real issue was parenting, or screen time management, or a user’s own preexisting fragility, as if the nature of this industrial behavior modification monster is our responsibility, essentially gaslighting the global population. Now a jury has looked at the situation and, with the dignity of common sense arriving five to ten years late, appears to have concluded that yes, in fact, Instagram (and YouTube et cetera) are doing exactly what they were built for.

They were built to farm the human mind.

What makes the ruling feel significant is not that it introduces some wild new theory, but that it ratifies an obvious one. The harm was never just the occasional bad post floating through digital space. Instead, it was designed. It lives in the engineered lack of stopping cues, the conversion of identity into metrics, and the fiction that all of this is helping people express themselves and connect. My ongoing Instagram investigation has been describing this central hypothesis since 2021, which is that the platform’s violence is not peripheral to the experience, but written in its code. The verdict lands less as revelation than as an overdue administrative update on reality.

This does feel like the beginning of a new phase, though not because the truth suddenly materialized yesterday. It was visible the entire time, staring up at us from the phone screen like a weird Harvard-educated vampire, asking a thirteen-year-old to keep scrolling until they feel numb. The court, at long last, seems to have noticed that when you build an environment around human vulnerability as a business strategy, the harm is not an unfortunate byproduct of the business model.

It is the business model.
